1. ACCEPTING THESE TERMS 

This document, our rules, policies and the other documents referenced make up our Terms and Conditions (“Terms”). The Terms are a legally binding contract between you and Suite 5116. This contract sets out your rights and responsibilities when you use www.suite5116.com. Please read them carefully.

 2. CHANGES 

We may amend the Terms at any time by posting a revised version on our website. The revised version will be effective at the time we post it. If we change the Terms in a way that reduces your rights or increases your responsibilities, we will provide you with a notification.

 3. ACCESS

You are granted a non-exclusive, limited and revocable license to access the website and use its functionality on the condition that: 

(a) You are over the age of 18; 

(b) You only use the website for lawful purposes; 

(c) You do not engage in any improper, indecent or offensive behavior while using the website; 

(d) You are not breaking any law in your relevant jurisdiction by accessing this website. 

4. TURN AROUND TIME 

Once payment is received; your order will be placed into our order queue. Please keep in mind all orders are prioritized and completed by event date.
Turnaround time is solely dependent on event date and current design load. Contact us BEFORE ordering, if you need a speedy turnaround under 14 business days.


5. PROOFING 

After we complete your requested design, we will deliver proof via email for approval. Please review your emailed proofs sent for text and grammar errors - we cannot be held responsible for any errors once the item(s) have been approved.
Once your order is approved, additional changes will incur an additional fee. 

6. IMAGE PIXILATION 

Image quality depends on the type of photo that is sent. If the photo sent is low resolution, your photo could possibly print blurry and decrease the overall product print quality. We are not responsible for image editing for resolution issues. Only send high resolution photos for best image print quality.

Typographical, spelling, and grammar errors: We are only human! Please review your emailed proofs sent for text and grammar errors - we cannot be held responsible for any errors once the item(s) have been approved.

7. COLOR DIFFERENCES 

There may be a variance in color(s) once printed than digital copies viewed on screen. Each computer monitor show colors differently.  

Please report any problems within 24 hours of receiving. 

8. PRICE AND PAYMENT 

The price of the products will be as stipulated by us at all material times. If we discover an error in the price of any of the products that you have ordered, we will inform you as soon as possible and give you the option of confirming your order at the correct price or cancelling it. Prices may change at any time. 

9. REFUSAL TO PROCESS AN ORDER 

We reserve the right to refuse services to anyone at any time and for any reason. 

10. ORDER CANCELLATIONS

If an order needs to be cancelled, please contact Suite 5116 as soon as possible. Depending on the stage of your order, there may or may not be a non-refundable design fee applied. If your order has been designed and printed, no refunds will be provided. 

11. PROHIBITED USES 

You may not use, or encourage, promote, facilitate, instruct or induce others to use, the website or services for any activities that violate any law, statute, ordinance or regulation; for any other illegal or fraudulent purpose or any purpose that is harmful to others; or to transmit, store, display, distribute or otherwise make available content that is illegal, fraudulent or harmful to others.

12. SHIPPING 

Item(s) will ship via UPS Standard Ground or FedEx Ground (2 - 5 day delivery depending on location) unless expedited shipping is purchased. Ground Shipping is not guaranteed. Please contact us to upgrade shipping if you are placing a rush order within the week of your event.

All guarantee policies set forth by the shipping carrier will apply to your shipped order. We are not responsible for lost, stolen, damaged packages, acts of God events, or weather delivery delays. Once package has been successfully delivered to carrier, ownership of package is transferred to the carrier to transfer to the buyer.

We are not responsible for mis-delivery errors via carrier due to customer entered incorrect shipping information. Please triple check your shipping address BEFORE completing order submission.

13. TERMINATION 

Suite 5116 reserves the right to change, suspend, limit or discontinue any of its Services, in whole or in part at any time for any reason, without notice (unless required by law).

We may refuse service to anyone and may terminate or suspend your services and your access to the website in whole or in part at any time, for any reason, without notice unless required by law. 

14. LIMITATIONS 

In no event will Suite 5116 be liable to you for any indirect, incidental, special, consequential or punitive damages (including damages for loss of profits, goodwill, or any other intangible loss) arising out of or relating to your access to or use of, or your inability to access or use, the website or any materials or content available through the website, whether based on warranty, contract, tort (including negligence), statute, or any other legal theory, and whether or not Suite 5116 has been informed of the possibility of damage. 

15. INDEMNIFICATION 

You agree that you will be responsible for your use of the website, and you agree to defend and indemnify Suite 5116 from and against every claim, liability, damage, loss, and expense, including reasonable attorneys’ fees and costs, arising out of or in any way connected with: (i) your access to, use of, or alleged use of, the website; (ii) your violation of any portion of these Terms, any representation, warranty, or agreement referenced in these Terms, or any applicable law or regulation; (iii) your violation of any third party right, including any intellectual property right or publicity, confidentiality, other property, or privacy right; or (iv) any dispute or issue between you and any third party. We reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you (without limiting your indemnification obligations with respect to that matter), and in that case, you agree to cooperate with our defense of that claim.

16. COPY RIGHTS 

Suite 5116 owns the rights to all custom graphics produced for all orders. Any purchased design may not be resold, altered or added to another design or reproduced in any manner without prior written permission from Suite 5116.  

Suite 5116 has the right to distribute and make use of any and all digital and physical products purchased, to be used in and/or for any lawful promotional materials including, but not limited to advertisements, press kits and submissions to journalists, websites, social networking sites and other print and digital communications without payment or any other consideration to the buyer. Facial features will not be shown at the client’s request. 

17. DISCLAIMER 

Kindly note that listings sold on this site are solely priced for time and creative services used to personalize design(s). 

All copyrights and trademarks of character images, illustrations, clip art or like characterizations used belong to the respective owner (s) and are not being sold. Designs are for personal one-time use only. 

Products created are not for commercial and/or licensed use nor are designs allowed to be altered or resold. 

Designs are strictly for personal use only. Items produced are not for commercial use. You may not forward, share, alter, sell or distribute any file (s) in whole or in part. 

18. ENTIRE AGREEMENT 

This Agreement contains the entire agreement and understanding among the parties hereto with respect to the subject matter hereof, and supersedes all prior and contemporaneous agreements, understandings, inducements and conditions, express or implied, oral or written, of any nature whatsoever with respect to the subject matter hereof. The express terms hereof control and supersede any course of performance and/or usage of the trade inconsistent with any of the terms hereof.
